Jammu is BURNING But Does It Bother Anyone?


As India has been living with "Terror" since long long time. Ask anyone who lives in Srinagar! But the whole concept of India being without it's proud "head" (see India's Map) is inconceivable and impossible. So why can't any Indian go ahead and settle down as a citizen of the state of Jammu & Kashmir? Because of the much discussed Article 370 of the Indian Constitution. The Article 370 says that only naturalized citizens of the state of J&K can purchase a piece of land in the state.

ARTICLE 370 OF THE INDIAN CONSTITUTION

Temporary provisions with respect to the State of Jammu and Kashmir

(1) Notwithstanding anything in this Constitution,
(a) the provisions of article 238 shall not apply in relation to the State of Jammu and Kashmir;
(b) the power of Parliament to make laws for the said State shall be limited to,
(i) those matters in the Union List and the Concurrent List which, in consultation with the Govermnent of the State are declared by the President to correspond to matters specified in the Instrument of Accession governing the accession of the State to the Dominion of India as the matters with respect to which the Dominion Legislature may make laws far that State; and
(ii) such other matters in the said Lists as, with the concurrence of the Government of the State, the President may by order specify.
Explanation For the purposes of this article, the Govermnent of the State means the person for the time being recognised by the President as the Maharaja of Jammu and Kashmir acting on the advice of the Council of Ministers for the time being in office under the Maharaja's Proclamation dated the fifth day of March. 1948;
(c) the provisions of article 1 and of this article shall apply in relation to that State;
(d) such of the other provisions of this Constitution shall apply in relation to that State subject to such exceptions and modifications as the President may by order specify:
Provided that no such order which relates to the matters specified in the Instrument of Accession of the State referred to in paragraph (i) of sub-clause (b) shall be issued except in consultation with the Government of the State:
Provided further that no such order which relates to matters other than those referred in the last preceding proviso shall be issued except with the concurrence of that Government.

(2) If the concurrence of the Government of the State referred to in paragraph (ii) of sub-clause (b) of clause (1) or in the second proviso to sub-clause (d) of that clause be given before the Constituent Assembly for the purpose of framing the Constitution of the State is convened, it shall be placed before such Assembly for such decision as it may take thereon.

(3) Notwithstanding anything in the foregoing provisions of this article, the President may. by public notification, declare that this article shall cease to be operative or shall be operative only with such exceptions and modifications and from such date as he may specify:
Provided that the recommendation of the Constituent Assembly of the State referred to in clause (2) shall be necessary before the President issues such a notification.

In exercise of the powers conferred by Article 370 the Prseident, on the recommendation of the Constituent Assembly of the State of Jammu and Kashmir, declared that as from the 17th Day of November, 1952, the said Article 370 shall be operative with the modification that for the Explanation in Cl. (1) thereof, the following explanation is substituted namely.

"Explanation - For the purpose of this article, the Government of the State means the person for the time being recognized by the President on the recommendation of the Legislative Assembly of the State as the Sadr-i-Riyasat (now Governor) of Jammu and Kashmir, acting on the advice of the Council of Ministers of the State for the time being in office."

Jammu & Kashmir has always been and shall always be an integral part of India it is really sad to know that a handful of misguided people in Kashmir are playing a "game" which shall leave them nowhere and this has been shown at different times and places across the state of J&K.

Coming back to the current topic of the LAND WAR which wages still at Jammu which has Kashmiri Pundits as majority, the curfew has been lifted from the city but the BANDH called by the Amarnath Sangharsh Samiti, which is against the recall of the transfer of land to the Shree Amarnath Shrine Board which is headed by the Governor of J&K.

The Congress(I) had been in power in a coalition Government in the state of J&K with Ghulam Nabi Azad being at it's helm as the Chief Minister.

But this issue which has suddenly snowballed into a major political battle amongst the different parties in J&K as the assembly elections are around the corner.

It was in March 2005 that the "said" forest land was transferred to the Shree Amarnath Shrine Board, the Board which was formed by the J&K State Legislative Assembly with the J&K Governor as it's Chairman and the Principal Secretary would be it's CEO.

And after four years of controversies around the transfer, on June 2nd, 2008 the Governor's demands was acceded to and the 39.88 hectares of land was given to the Shree Amarnath Shrine Board.

But this became a huge political drama and it also went violent and crippled the J&K state and it disturbed the already hapless and hugely poor people of the state.

Before the withdrawal of the said Transfer of Land to SASB Srinagar went onto agitate and now when they have stopped Jammu is burning!

BUT

How many of us Indians are willing to share the feelings of the people of Jammu and come together and support them?

Do they feel left out?

Do the people behind the Sangharsh Samiti think they have the unconditional support of people outside the state of J&K?

Well I think there should be a permanent transfer of the said land so that there can be a peaceful co-existence of all and also it shall bring about a sustained development of this area while bringing the much needed infrastructural support for the millions of pilgrims and in turn it would also bring about more people to the area.

WHY?

WHAT AILS THE INDIAN LAW ENFORCEMENT AGENCIES

It has been years and years of terror attacks in different locations across the nation few thousands have died in these barbaric attacks on humanity. Those who have suffered mostly are poor people, defenseless people, people who are simpletons living in difficult conditions and who in most probability never ever hurt anyone ever. But then life is such. Death is instant and never knocks before coming in the forms of bombs; in different shapes sizes and forms. The bullets which flow from the Kalashnikov's

We have yet to come across one such terror-act which has been investigated successfully and all the culprits, the conspirators, the activators, the perpetrators and their support groups have been put behind bars, sentenced for life or death.

For the few years now we all have been debating whether or not the highest court of India - The Supreme Court of India - which had upheld the sentence of death to the mastermind behind the gruesome attack on Indian Parliament, on 13th December 2001, Afzal Guru should be hanged till death or not.

It is indeed a shameful moment for all of us Indians as we have collectively failed to put pressure on the Government of India to act on the sentence given towards the culprits, who have been found guilty. Imagine! These are clear political reasons behind these blatant misuse of legislative powers in derailing the growth of the nation as a whole.

Who targets a hospital? Kids? Old women? Old Men?

None but people who are inhuman and mentally ill.

Our policing has failed once again and so has our Intelligence. I have always wondered what has our Indian Intelligence departments like the RAW and IB have contributed towards making India a safer place?

Can anyone remind me of any incident where our Intelligence agencies acted and STOPPED before anything ghastly could occur?

NONE.

We should scrap these agencies and sack the people who run them. They all have become stagnant and slack. Recruit new fresh young talent and train them. Use them to the advantage for the nation. The challenges which lie ahead of all Indians is to be a part of the nation-building process and not just go about doing their monotonous 9to5 jobs and be selfish. Freedom as I have earlier mentioned is not well defined for us Indians. The Generations X Y etc etc doesn't know the value of freedom. There is no context for them to become responsible citizens of India. There is no sense of National Pride except for when they are in a cinema theatre where they stand up in respect when the National Anthem is played. There is more to it than just the anthem and the flag.

I appeal to everyone to become more aware of their own surroundings and help India become one strong nation and educate themselves on how they can contribute to tackling these maddening terror attacks.

What happened day before yesterday in the Parliament has brought to the fore the corporate-broker-politician nexus out in the open which currently rules the politics of India.

The unholy nexus has been clearly PLAYED OUT on National TV like never before. Earlier the moneybags which were delivered were always hush-hush and never talked about by anyone out in the open like it has been this time around thanks to the growth of Media.

Every channel was hoping they could find something like this and when CNN-IBN TV news channel was given this "scandal" on a silver platter they developed cold feet and didn't show it to the entire nation, which they should have if their personnels were involved in shooting the entire "Bribe for Vote" scenes.

The editor in chief of CNN-IBN Rajdeep Sardesai, who is one of the reputed journalists in India today, goes ahead and shows how coward he is and he couldn't muster up enough courage as a Media-person and telecast the show! What stops some one like him from doing his duty as a journalist? I wonder. Its indeed a shameful and cowardly act by him and his entire channel management. The Indian public needs to know what happened and who was paid, why, what for and when? Isn't the media a free medium? When it comes to frivolous issues such as someone's personal choices with regard to what he/she eats, sleeps with wakes up and what not they go ahead and make it sound like Breaking News! And when actually the NEWS occurred and they had it on a platter what stopped them from showing it to the world? Why did Rajdeep suddenly appeared to have developed cold feet on this issue? Is there something we (the People) don't see that he is scared by the Government?

That's why in my previous posts I asked for the tabling of the Media Bill in the Parliament which is languishing in some obscure corner of the office of the I&B ministry for more than a year now. Why? We as Indians want to know!

I ask for a balanced approach and I hope that the Speaker of the Lok Sabha Somnath Chatterjee will live up to his "democratic" image and dig the truth out. But as Indians we deserve to be treated with a little more dignity and respect from the very people who we elect. So please please be brave face the world and expose the maladies of Indian democracy and make it stronger and more transparent.

And Rajdeep please shun your double-faced attitude and be brave. Courage is not an alien word for us. We have fought and we shall keep fighting for the Truth and nothing but the absolute truth.

Or has the Congress(I) threatened CNN-IBN that if they transmitted the STING their license could be revoked? Huh? Is this the reason you back-tracked? Well if this be the reason you should give up the profession and give brave youngsters a chance to showcase their talents in the field of journalism!

And if you weren't threatened and you gave up the idea of telecasting the STING we need to know why?

Meanwhile, we closely follow the happenings around the Capital where the real wheeling-dealings begin now.

JMM's Shibu Soren, SP's Amar Singh and others are supposedly going to be awarded by the Government. How we shall await and see. Is this above board? Is Reliance ADAG's Anil Ambani now a more powerful corporate head honcho in the country? Will he again come up with an IPO for Reliance Political Fund? (As last time we saw the IPO for Reliance Power - where not even a single Mega Watt of Power has been generated!)

We all Indians need to wake up and start learning from our past mistakes.

What did one expect from the Indian democratic way but the same good old fashioned disciplined / indisciplined honorable and not-so-honorable Members of the Parliament.

It came as a shock to me and I totally disagree with Hon'ble Speaker Shri Somnath Chatterjee - who I thought was a very well balanced politician and a statesman, today he let me down as he said that all these "Chargesheeted / Convicted Members of Parliament like Suraj Bhan Singh, RJD's Rajesh Ranjan alias Pappu Yadav, Md. Sahabuddin, BSP's Umakant Yadav, Samajwadi Party's Afzal Ansari and expelled SP MP Atiq Ahmed have all been given BAIL to go to the Parliament and cast their votes and I have allowed them to be present here."

It is one amongst the lowest moments of Indian Democracy when a motley group of convicted persons are allowed to become a part of the Government - the same Govt. which has punished all of them - put them behind bars - and then how they are allowed to be a part of the law-making process which shall rule the poor the rich and all of the in-betweens. They suddenly become the law makers! Such a sad state of affairs.

The UPA-led Government which is now holding the great Indian Parliament tamasha with leaders like Laloo Prasad Yadav (The Joker) and a school-boyish debate/elocution speaking Rahul Gandhi. This is not what we as Indians have sent them to Parliament for! Its indeed a shameful moment in the democratic process of India. The one's who are well-read and mature as statesmen have been waxing eloquent these two days in Parliament like Pranab Mukherjee, Arun Sharma and P Chidambaram . But amongst all of it there was no one who could convince me on the Nuclear Treaty and all the apprehensions on the same by various political parties.

But then how can we forget that Congress(I) has been the root cause for all of India's malices and maladies. The largest democracy has been run mostly by the same party for the maximum numbers of terms and years and it should be their failures and successes if any at all. The deaths of farmers across Maharashtra, Karnataka and Andhra Pradesh and elsewhere goes to show how much the poor man of our country has been looked after since the last 50 odd years. Where are the basic needs of a human being - Roti Kapda aur Makaan?

I do not deny that the late PM Rajiv Gandhi had a vision because of his worldly wise vision of the future. Late PM Indira Gandhi too was an able administrator but then began the cycle of corruption during her regime and its the most dangerous disease which ails our country today.

But PM Narasimha Rao was the first PM in office, in the entire history of Indian democracy, who was charge-sheeted by the court of law in the infamous JMM bribery case. Today again Shibu Soren has bargained for his party's pound of flesh and in the coming days we shall see what he had asked for and got. The very important point that TDP MP Adikesavalu has once again brought into the fore-front as he is voting against his party's whip; in support of the Congress(I) led UPA. He is the same MP who was also charge-sheeted alongwith the five JMM MP's in that bribery case.

I call upon you all and hope more and more youth of today's India should take part in the politics of the country as only with the infusion of new blood and enthusiasm and zeal can we get a better India - a bright future for our generations ahead.

Hope the Generation Present shall come out and try and change the way we are Governed!

Wake Up Indians!

The Great Indian Democratcy Drama - UPA, NDA, UNPA & Single Party Gangs of Politicians

India is the LARGEST KICKING DEMOCRACY in the whole wide world!

Not me!

We are still grappling with so called democracy - as the "state" has never been able to ward off the threats towards the admonishing of the very basic tenets of democracy - ETHICS, PRINCIPLES, WELFARE, RIGHTS & DUTIES, HONESTY, INTEGRITY and above all the simple belief in being TRUE to the NATION. If the way our Honourable Members of the Indian Parliament are going about doing their JOBS in today's scenario one sees the "selfish" motives so clearly.

The current political uncertainity in the country is quite alarming for any citizen of the nation as the ruling UPA - United Parties Alliance which is lead by one of the oldest Indian political party - the Congress-I(Indira) apart from other small parties. Till now the Left Parties - the CPI and CPM and others had supported the Government in running the business of India. It's so heartening to experience the diversity of Indian politics that a party which has support of not even one-third of India rules the country and tries to propagate and execute their own divisive and leftist agenda.

After the Left pulled the plug off the UPA led Government at the centre, the Congress(I) has started doing what it has always done best - HORSE TRADING! We have already seen, heard, read and witnessed the way erstwhile Prime Minsiter Late P V Narasimha Rao was accused of saving his fledgling Government with the help of Shibu Soren and his coterie from Jharkhand. Then it was alleged, that Shibu and his fellow MP's were given cash to vote for the Government in the test of strength in the Parliament.

Today we are reminded of that grim situation once again as this time the same faces who have known to be facing various charges - some as grave as murders - are coming out from the jails to vote for the Government. It is indeed a decaying state as majority of the Indian population is it's youth (average age 26) and they hardly take time out from their own world of studies, colleges, music, movies, fun and games to have a say in where India is headed. I just blame our poor education system of which majority is so farcical, ancient and decadent.

Today a non-Congress(I) MP (Member of Parliament) is being offered a variety of options as being repeatedly reported by Indian media across all platforms. If you are a SP (Samajwadi Party) MP and you have two minds about voting in favour of the UPA led Government then what do you have!

1.) You get a chance of being in the ruling Government.
2.) You need cash ? OK. We can arrange that. Rs.20-30 Crores per MP is the asking rate.
3.) You also might be made a minister in the Govt. of India
4.) You will be taken good care of if you are with us we can get your

The next is Ajit Singh. He came back from abroad to his home nation to kickstart his career in politics in his unique style. He started to gain notriety after he managed to steer his way into the Ministerial berths in majority of Governments in the centre.

Today the UPA led Govt. has announced that the Lucknow Airport be re-named in honour of Chaudhari Charan Singh, a charismatic leader of Uttar Pradesh and ironically the father of Ajit Singh. This is a welcome move but the timing of the same casts aspersions of the ethical standards of today's Govt. As the Congress(I) needs support from all the possible quarters Ajit Singh with his 3 MP party can play a crucial role. Ajit Singh came back in 1986 and today in 2008 he has changed six parties and been minister in almost all Govts at the centre - this time again he needs a berth.

The other man in the fray is Mr. H D Deve Gouda - (ex-Prime Minister) -(whose photographs of snoozing at major govt. & public functions was quite an eye-catcher) has been offered a huge sum of money and his demands for abolishing private Iron & Ore mining in Karnataka are also under "HIGH" considerations. We all know how the Reddy Inc. from Karanataka have managed to form the current BJP led Govt. there. Its been a full-strength show of how money can buy politicians. But till now Deve Gouda says he is undecided as the above two party leaders - Mr Shibu Soren and Mr Ajit Singh.

While Amar Singh, who started his career from the lower echelons of corporate houses in Kolkata and now boasts of A 3 Gang - Amitabh, Anil & Amar! as family has clearly played his power politics with a heavy dose of Corporate Mergers&Acquisitions style. Rajdeep Sardesai, the Managing Editor of CNN-IBN had recently written about how Amar Singh is today's Neta! (Politician) who openly flaunt their associations with coroporations as they know how Government's run. Being an opportunist is what Politics has always been about. The first mover advantage does play an important role here. He is the same guy who had borne the brunt of snares and glares and much mockery when the last Elections had finished and Congress(I) was the single largest party. Then Amar had visited the mecca of Indian politics - 10,Janpath - the residence of the most powerful woman in India - Mrs Sonia Gandhi. He went their uninvited and addressed the media that their party, the Samajwadi Party with its 39 MPs were giving unconditional support to the Congress(I) led association amongst various political parties to go and form the Government.

He was humiliated by Congress(I) leaders and the NDA at the same time. But today he is the blue-eyed Man for Mrs Gandhi as he holds the key to the successful show of strength in the Parliament for the ruling alliance.

I personally feel that there is no wrong to ask Reliance Petroleum to pay taxes - windfall profits has been earned by the company with its exports! It was also raised by International bodies when the petroleum prices were shooting up in the sky, that how could Govt. of India allow its private OIL companies to export when they themselves were importing OIL at higher prices!

Imagine - I am Govt. and I create a product A and sell it across the nation at subsidised rates so that all the poor and rich alike can avail of the product.

Then a Private Company is also allowed to create the same product and its free to export it too. But then when disaster strikes shouldn't the private company think of the nation? Is there no sense of being Indian? Instead they create history by exporting in highest volumes. So why shouldn't the Govt. ask the company to pay taxes? Whats wrong? Where?

This is the situation where the Ambanis feud hots up. And as Amar Singh is close to AA, MA seeks the intervention of PMO. Hot call!

Things as they unfold - the political drama - our media is busy getting different views and its appreciated but educate, sentisize and drive home the basic tenets of Democracy - that India is our heart, our Motherland and we as Indians should not fail her.

The Sad Demise of NEWS on TV

We all know how the Indian TV News has gone to the dogs!

On the whole just one incident which has proven once again the deteriorating standards of news television in our country. I have earlier posted my reservations against the news channels in India and hereby I again PROTEST the way things are going without any control by the Government or the Society.

The Arushi Murder Case has thrown open the monster we have in the name of TV News. We as a society are going nowhere; there is no collective mindset of a society to begin with. We are never one as a society except when some leader appears and leads us. Thats such a pity for the ancient society we boast ourselves to be a part of. Where is the backbone of our self-appointed social activists in this scenario? Why doesn't anyone come aboard and start a dialogue against the highhandedness and the lewd remarks made by the TV news channels in this particular case? Where are the so called moral-policing authorities hiding? Why there is no hue and cry against the "Media Trial" which had framed Arushi's Dad Dr R Talwar and also held him guilty by default - leveling charges that were slanderous and obstructive to justice?

Some of our TV news channels like India TV, Aaj Tak, News24, Zee News, Headlines Today should be taken to task and should be penalised and they should be made to apologise with a ticker on their channels expressing regret at what they did while the Police and the Family were all bewildered at the heinous crime. Some TV channels like the NDTV, TimesNOWhave begun to take the high moral ground and started debating the fiasco with fellow media persons but that doesnt solve what has already been damaged.The very characters of the aggrieved families and also of their friends and neighbours have been tarnished by the self obsessed TV News reporters and presenters that they forgot that had it occured in their own families how would they have reported the event?

Their is no ethics and principles in today's TV News. Whomsoever gets the first news calls itself Breaking News and it has become a sort of joke in our society that to feature in breaking news of any channel all one has to do is to attempt something abnormal and ghastly!

It's high time that the Media Bill which has been lying un-passed by the Indian Parliament, gathering dust at the Information & Broadcast Ministry of India, should be brought back debated and passed.

We think we are free and we can do whatever we want and speak whatever we want because wedo not have the sense of responsibility and we can get away with it!! No!

I think we as Indians do not have one thing in our lives amongst many other attributes - a discipline!

As our Army Chief had proposed we all Indians should have a compulsory Military Training. I agree with the Chief as the "DISCIPLINE" shall be inculcated amongst the Generation Next of India and we can see a new society which shall have a certain sense of responsibility and concern amongst fellow Indians.

Compulsory military training favoured

CONGRATULATING the NCC cadets of Punjab and Chandigarh for winning the maximum number of medals at the Republic Day parade in New Delhi, the Governor of Punjab and Administrator of Chandigarh, Justice O.P. Verma (retd), has emphasised the need for making military training mandatory for every citizen of the country. This training was essential to inculcate a sense of discipline and spirit of adventurism in them. Today, we are almost on top in corruption in the world. The words honesty, sense of duty and self-discipline are scoffed at by our citizens. So much so that an honest man cannot exist in any organisation. Shamefully, the country is at its nadir in all spheres of life. We have gone too far on the path of evil, the Governor said on February 1. The only way to bring the nation back from this is to make military training compulsory for the youth. In fact, this should be made a pre-requisite for joining any service. In a few years, this measure can extricate us from the stinking morass that is sucking us deeper and deeper into it. The Territorial Army and the NCC are the two shining examples of disciplining the citizens, which in an emergency can provide the second line of defence for the country. The best way to impart military training to the youth is to make NCC training mandatory for all school and college students.

So lets create awareness amongst each other.Come together change for better. Step forward. Do not sit back and say "IT DOESN'T CONCERN ME" !!It's Enough !

I say to those irresponsible Media Houses who do not do their duties with ethics and responsibilities. Next maybe I shall go the legal way and make sure that all those wannabees media journalists are taken to court!

You cannot take anything for Granted!Freedom is not to do away with the Truth and just Create Shams and Report without any sense of Responsibility.
